Privacy Policy

Last updated: 8 October 2026

1. Who we are

This policy is from Toby William Chilver, registered on the Australian Business Register as CHILVER, TOBY WILLIAM ("we", "us"), a sole trader (ABN 30 432 784 574) providing coaching under the program names GoNomad and StayNomad, of 3 Dakin Place, Hackett ACT 2602, Australia. Website: yournomadcoach.com. Email: [email protected]. Phone: +61 451 493 255.

We decide how your personal information is used, so we are responsible for it.

2. Who this policy covers

This policy applies to you if you:

  • visit our website (yournomadcoach.com), funnel or sales pages;
  • apply for coaching or book a call with us;
  • join a call with us;
  • become a client; or
  • sign up to hear from us.

If you become a client, section 23 of your Client Services Agreement also applies. If the two differ, the Agreement applies.

3. What we collect

  • Contact details: name, email, phone or WhatsApp number, country.
  • Application answers: work situation, goals, budget, and other answers you give.
  • Call records: recordings, transcripts and summaries of sales calls and coaching Sessions.
  • Messages: emails, SMS and WhatsApp messages with us.
  • Payment records: amounts, dates and card type. Stripe handles your card details; we never see them.
  • Program records: Session attendance, milestone evidence (such as a resignation email or receipt), feedback.
  • Sensitive information: health (including mental health) or other sensitive details, only if you choose to share them.
  • Website data: pages visited, device and browser, IP address, and cookie and pixel data.
  • Marketing content: testimonials and clips, only with your separate written consent.

4. How we collect it

We collect information directly from you (forms, calls, messages and payments), automatically when you use our website (cookies and similar tools), and from our service providers, such as Stripe payment confirmations and Meta advertising reports.

5. How we use it

We use your information to:

  • assess your application and hold sales calls;
  • deliver coaching and manage your Agreement, payments and reminders;
  • keep records and meet tax and legal duties;
  • handle complaints, refunds and payment disputes;
  • improve our Programs, in a form that doesn't identify you;
  • measure and improve our advertising;
  • send you marketing emails about coaching offers, discounts, free resources and updates;
  • send you marketing messages by SMS and WhatsApp; and
  • handle sensitive information you share.

If you are in the EU or UK, the legal basis we rely on is:

  • Steps you ask for before a contract, and our legitimate interest in finding suitable clients: assessing your application and holding sales calls.
  • Contract: delivering coaching and managing your Agreement, payments and reminders.
  • Legal obligation: keeping records and meeting tax and legal duties.
  • Legitimate interest: handling complaints, refunds and payment disputes, and improving our Programs in a form that doesn't identify you.
  • Consent, or legitimate interest where consent isn't required: measuring and improving our advertising.
  • Consent: marketing emails, and marketing messages by SMS and WhatsApp.
  • Explicit consent: handling sensitive information you share.

We may also tell Meta that you applied, qualified or bought a Program, using coded (hashed) versions of your email address, phone number, name and country, to measure and improve our advertising. We never send Meta your text-message consent, and we never share your application answers, financial details, or anything you tell us in Sessions. Where the law requires your consent for this, we only do it if you have given it, for example through our website's cookie settings.

6. Recording calls

We record, transcribe and summarise sales calls and coaching Sessions using Fathom. We tell you before a sales call starts, in the booking confirmation and at the start of the call. If you don't want a sales call recorded, tell us and we will turn recording off. Clients agree to Session recording in their Agreement (section 24).

7. Cookies and advertising

Our website uses cookies and similar tools, including the Meta pixel and other analytics and advertising tools, to measure visits and improve our ads. If you are in the EU or UK, we ask for your consent first through our cookie banner, and you can reject non-essential cookies.

To help Meta show our ads to people likely to be a good fit, we may tell Meta that you applied, qualified or bought a Program. When we do, we send only coded (hashed) versions of your email address, phone number, name and country. Hashing turns them into a string of characters that Meta uses to match the event to an account. Meta doesn't receive them in readable form. We never send your text-message consent to Meta. We never share your application answers, financial details, or anything said on calls with Meta.

8. Messages from us

Marketing emails. We send marketing emails about coaching offers, discounts, free resources and updates only if you tick the "Offers by email" box on our application form.

Marketing SMS and WhatsApp. We send marketing text messages only if you tick the "Offers by text" box on our application form or on your Order Form, and we don't send marketing on WhatsApp. WhatsApp messages about your coaching, including support, are sent only if you tick the "WhatsApp" box.

Messages that aren't marketing. We send emails about your application, your booked calls and your Agreement, such as confirmations, reminders and receipts. These aren't marketing, so they don't depend on marketing consent. We only send these messages by text if you tick the "Texts about your application" box on our application form or on your Order Form.

Withdrawing your consent. You can withdraw any marketing consent at any time, and it's free:

  • Emails: click the unsubscribe link at the bottom of any marketing email, or email us.
  • SMS: reply STOP to any text, or email us. Replying STOP stops both our text programs (see our Terms of Use, section 6). To leave only the marketing program, email us.
  • WhatsApp: reply STOP or block our number, or email us.
  • Anything else: email [email protected] and tell us what you want to stop.

We action withdrawals promptly. Withdrawing doesn't affect anything we did while your consent was in place, and it doesn't affect your Program or any guarantee.

We don't sell your mobile number. We don't share your mobile number or text-message opt-in data with third parties or affiliates for their own marketing or promotional purposes. The only exception is the coded (hashed) phone number described in section 7, which Meta uses on our behalf to measure our own ads. Text-message opt-in data and consent are never shared with any third party.

9. Sensitive information

During calls you may choose to tell us about your health, including mental health, or other sensitive matters. You never have to. Clients consent to us handling this information for coaching in their Order Form, and can withdraw that consent at any time.

10. AI tools

We use AI assistants, such as Claude (Anthropic) and ChatGPT (OpenAI), and Fathom's AI summaries, to prepare for calls and research your needs. We have turned off the use of our data to train their models where our plans allow it. AI summaries can contain errors and are not a formal record.

11. Who we share it with

We don't sell your personal information. We share it only with:

  • GoHighLevel (LeadConnector): website, forms, scheduling, email, SMS, documents and payments.
  • Stripe: payments.
  • Google: Meet, Drive and email.
  • Fathom: recording, transcribing and summarising calls.
  • WhatsApp (Meta): messaging.
  • Meta: advertising measurement and optimisation, using the Meta pixel and coded (hashed) contact details (section 7).
  • Anthropic and OpenAI: AI assistants (section 10).
  • Our lawyer and accountant: professional advice, under a duty of confidentiality.
  • Your bank and Stripe: if you dispute a payment.
  • Emergency services: if we believe someone is at serious risk of harm.
  • Courts and regulators: where the law requires it.
  • A business we transfer to: if client Agreements move to a business we control or a buyer (Agreement section 33).

Each provider handles your information under its own privacy and security terms.

12. Overseas transfers

We are based in Australia. Our providers store information in other countries, mainly the United States. If we move our business to a company we control, your information may move with it, including to the United Arab Emirates. Where the law requires it, we rely on safeguards our providers offer, such as standard contractual clauses.

13. How long we keep it

  • Applicants and call bookings who don't become clients: until you ask us to delete it.
  • Sales call recordings, transcripts and summaries (non-clients): until you ask us to delete them.
  • Client Session recordings, transcripts and summaries: until you ask us to delete them.
  • Client Agreement and payment records: 5 years after the Agreement ends.
  • Client messages, application answers and other records: 2 years after the Agreement ends.
  • Testimonials and clips (with consent): while we use them; deleted within 14 days after you withdraw consent or we stop using them.
  • Marketing list: until you unsubscribe. We then keep only what's needed to stop messaging you.
  • Cookie choices: as set by our cookie banner, then we ask again.

We may keep information longer if we need it for a dispute, a money-back guarantee claim that could still be made, or a legal reason.

14. Your rights

You can ask us to:

  • give you a copy of your personal information;
  • correct it;
  • delete it;
  • stop or limit how we use it;
  • give it to you in a format you can move to someone else; and
  • stop sending you marketing.

You can also withdraw any consent you've given, without affecting what we did before.

Email us to make a request. We will respond within 30 days and may ask you to confirm who you are. We may need to keep some information where the law requires it, such as payment records.

You can complain to us first, or to a privacy regulator:

  • Australia: Office of the Australian Information Commissioner (oaic.gov.au)
  • United Kingdom: Information Commissioner's Office (ico.org.uk)
  • European Union: the data protection authority in your country

If you live elsewhere, including a US state with privacy laws, you may have similar rights. Contact us and we will help.

15. Security

We take reasonable steps to keep your information secure, including using reputable providers. If a data breach is likely to cause you serious harm, we will tell you as soon as practicable.

16. Under 18s

Our services are for people aged 18 and over. If we learn we have information about someone under 18, we will delete it.

17. Changes to this policy

We may update this policy. We will post the new version here with a new "Last updated" date, and email clients about any significant change.
